LOCAL EMERGENCY PLANNING COMMITTEE (LEPC)
MINUTES
DECEMBER 17,1999 Meeting
Present: Jack Colvard, Mary Souter, Emergency Government; John
Mortensen, Art Jacobson and Bob Boche, County Board; Dan Smith,
Hudson Fire/Bay West; Steve Schofield, Highway; Wendy Kramer,
Public Health; Rick Huston, United Fire & Rescue & Woodville
Ambulance; David Hausman, DNR and Craig Olson.
The meeting was called to order at 1:05 p.m. by Chairman Smith. The
agenda was adopted on a Jacobson/Boche MOTION. The August 20,1999
Minutes were approved on a Jacobson/Huston MOTION.
The next meeting will be Friday, February 11, 2000 at the Government
Center.
OLD BUSINESS
1. Spill update & Cost Recover
Colvard submitted bills to the J B Hunt Trucking Company's Insurance
Co. for the cost of the June 25, 1999 spill at Hwy 128 & I - 94.
These costs were approximately $3000.00. To date, local responding
agencies have not received payment for their services. The only way
these agencies may collect is to take the trucking company to court.
This may be cost prohibitive. Recommendation, from the Committee, is
that State Statue 166 should be changed to incorporate some form of
penalty against the trucking companies which do not reimburse local
response agencies for their costs in responding to a hazardous material
incident.
The Committee recommends that all state elected officials, serving St
Croix County, be requested to attend a meeting addressing these
concerns and issues.
2. LEPC Membership
Colvard requested the names of individuals to replace several members
who have resigned from the Committee. Mary Souter, will be the new
secretary. Joe Winter, Hudson Star Observer, was recommended as a
member.
NEW BUSINESS
1. New Richmond Full Scale Exercise
Colvard informed the Committee about a full-scale exercise that the
City of New Richmond emergency service agencies participated in. The
exercise was the 3rd in a series funded by a Hazardous Material
Emergency Planning grant. The total cost for all three exercises,
$2855.52 was reimbursed by the State.
2. PLANS UDATED FOR QUARTER
Off -Site Facility plans updated during the first quarter of Federal
Fiscal Year (FFY) 2000, (Oct, Nov & Dec) Hudson Wells 3,4,5,E & 7.
3. REVIEW LEPC POLICIES
The LEPC's plan of work under the SARA (Superfund Amendment &
Reauthorization Act) grant requires the review of the the following
policies:
A. Hazmat Response Expenditures:
Item to be discussed with Old Business #1 item.
B.LEPC Inspector:
Prior to 1998, Frank Ivy was the designated inspector for the
County LEPC. In 1998 the LEPC elected to have the State as
the designated inspector for the County. Mortensen/Olson
Motion that the State remain the LEPC inspector.
C. ESTABLISHING 311 & 312 FILES
Colvard recommended to the committee that the current policy
should remain the same. Motion by Smith/Huston to keep the
same policy.
D. ESTABLISHING 304 FILES
Colvard recommended to keep the current policy. Motion by
Jacobson/Mortensen to continue with this policy.
E. REQUESTS FOR INFORMATION -Section 324
The Policy was established before Colvard arrived at St.
Croix County. Motion to keep the same policy by
Smith/Mortensen.
4. Public Comments
A. SPILL SURVEY 1993-1998
A copy of the spill survey compiled by the Department of
Health and Family Services was distributed to attending
Committee members. This identified the spills by county from
1993 through 1998.
B. HAZMAT DISPATCH
Brantner & Colvard have changed the spill reporting procedure
& form for dispatchers to include notification to the
National Response Center as part of their procedure.
C. WAHMR 2000 WORKSHOP
Tabled until next meeting.
D. EXERCISE DESIGN CLASS
There is a State sponsored course available to be presented in Menomonie
in April. Also, if anyone is interested in lieu of a 3-day class,
Colvard could possibly make arrangements to have a 1-day workshop
presented here at the Government Center. However he would need 20-24
people willing to take the class. He is accepting names for the
workshop.
