CROIX COUNTY LOCAL EMERGENCY PLANNING COMMITTEE (LEPC) MINUTES August 20, 1999 Meeting Those present included: Jack Colvard, Pam Benson, Emergency Government; John Mortensen, Chuck Mehls, Art Jacobson, Robert Boche, County Board; Dan Smith, Hudson Fire/Bay West; Brad McAbee, River Falls City; Jim VanderWyst, New Richmond Fire; Kitty Rhoades, State Representative; Leonard Laskow, West Industries, Inc.; Steve Schofield, Highway; Bob Klanderman, Sheriff's Dept.; DJ Weber, Salvation Army; Tom Overby, Precision Ag.; Ed Mishefske, West Central Hazardous Response Team; and Terry Shafer, Spring Valley Fire. The meeting was called to order at 1:04 p.m. by Chairman Smith. The meeting agenda was adopted on a Mortensen/VanderWyst MOTION. The June 16, 1999 Minutes were approved on a Boche/Mortensen MOTION. The next meeting will be held Friday, October 22, 1999. Meeting location is to be at the Government Center. OLD BUSINESS 1. 2/18/99 Spill Update on Cost Recover This item was discussed under New Business, #1. 2. LEPC Membership Colvard said St. Croix County's LEPC membership list was approved by the State, although it was noted that there was no State elected official on the Committee. Rhoades stated that she would be willing to serve on the Committee. After discussion, a Mortensen/Jacobson MOTION was approved to recommend to the County Board Chair, Thomas Dorsey, that Kitty Rhoades be appointed to the LEPC. Introductions around the table were made. 3. Functional Exercise Planning -Precision Ag. Discussion on when to have a functional training exercise at Precision Ag. was next held. Overby stated that Precision Ag. is willing to host an exercise at their facility when it can be scheduled. Early spring may be the best time for a future exercise. Training for local emergency responders was discussed. Mehls will encourage more training for local responders at a class he is presenting on 8/31. Mishefske stated that a liaison person from the Regional Team would be available to speak to the fire chiefs' organization at no charge, if invited. NEW BUSINESS 1. 6/25/99 Spill Incident Report and Cost Recover Copies of letters received and sent regarding a 6/25/99 hazardous material spill at the Kwik Trip at Highway 128 and I-94 were given to those present. Also discussed was correspondence from the 2/18/99 spill involving Stevens Transport, and the non -reimbursed costs to date. Shafer described the 6/25 spill incident to the Committee, as he was the Incident Commander. As Shafer stated, his main concern was public safety and he acted accordingly. JB Hunt, the trucking firm UNOFFICIAL RECORD involved with the 6/25 spill, has stated that they will not pay for costs associated with the spill, including local emergency responders' charges. A speaker phone call was next made to Randi Milsap, the State's attorney at WEM (Wisconsin Emergency Management), regarding the best way to proceed with cost recovery. Per Milsap, the State can only represent the West Central Hazardous Response Team, as there is an attorney/client relationship between them. Other response agencies must work with their local municipality's collection procedures. After further discussion with LEPC members, it was decided that Colvard will draft another letter to be sent to JB Hunt. Milsap stated that she would be happy to review the letter before it is sent. Response agencies will also be given a chance to preview the letter. At 2:25 p.m. a short break was taken. Mishefske, Shafer, Klanderman, VanderWyst and Schofield left the meeting... 2. New Richmond Full -Scale Exercise A full-scale exercise will be held on October 12th at the New Richmond Airport. This will be the 3rd phase of training, as a tabletop and functional exercise have been held. Mehls explained what the training will involve to LEPC members. Colvard asked for volunteers to be evaluators at the exercise. Possible candidates were brought up. 3. Plans Updated for Quarter The following off -site facility plans have been or are being updated for the quarter: 1. Wastewater Treatment Plant - New Richmond 2. Foremost Farms USA Cooperative - Wilson 3. Cady Cheese Factory, Inc. - Wilson 4. Changes in Facility Reporting Requirements As of January 1, 2000, gas stations will not be required to report their hazardous materials to WEM/SERB (State Emergency Response Board). As a result, State grant funding may be affected. 5. Public Comments A major release occurred in Dunn County on July 1st, involving a tanker hauling LP fuel. I-94 was closed for several hours. Other handouts were read to the Committee and a revenue report from the State was also made available to Committee members.
