HomeMy WebLinkAboutResolution 2019 (33) Resolution No. 33 (2019) ST C RQ RESOLUTION AUTHORIZING PLACEMENT AT THE CORE ACADEMY AND OTHER SECURE DETENTION FACILITIES FOR PERIODS NOT TO EXCEED 365 DAYS 1 WHEREAS, the St. Croix County Board of Supervisors adopted Resolution No. 16 (96) on 2 August 20, 1996 authorizing St. Croix County Circuit Court judges to order placement of 3 juveniles in the Northwest Juvenile Detention Center for periods not to exceed 30 days; and 4 5 WHEREAS, Wis. Stat. § 938.34(3)(f)1 allows for a 365 day placement in secure or non- 6 secure detention as a disposition for adjudicated delinquents; and 7 8 WHEREAS, Wis. Stat. § 938.06(5)(a) requires the county board of supervisors, by 9 resolution, to authorize the court to use placement in a juvenile detention facility as a 10 disposition under Wis. Stat. § 938.34(3)(f); and 11 12 WHEREAS, if a juvenile's placement exceeds 30 days, whether or not consecutive, the 13 county department is required to offer the juvenile alcohol or other drug abuse treatment, 14 counseling, and educational services under Wis. Stat. § 938.34(6r); and 15 16 WHEREAS, on September 5, 2017, the St. Croix County Board of Supervisors adopted 17 Resolution No. 29 (2017) authorizing the St. Croix County Circuit Court judges to order 18 placement in the Northwest Regional Juvenile Detention Center for periods not to exceed 365 19 days as a disposition for adjudicated delinquents with the condition that the placement greater 20 than 30 days would offer alcohol or other drug abuse treatment, counseling, and education 21 services; and 22 23 WHEREAS, Lincoln Hills and Copper Lake Schools, which are the state's secure juvenile 24 correctional facilities for male and females, is planned to close in July 2021; and 25 26 WHEREAS, current planning for two new state secure facilities, along with four counties that 27 have submitted grant applications to administer Secure Residential Care Centers for Children 28 and Youth (SRCCCY's), would be located in the eastern and southern portion of the state; and 29 30 WHEREAS, these new planned facilities are a considerable distance from St. Croix County; and 31 32 WHEREAS, Health and Human Services, Children Services Division has identified other facilities 33 that will accept placement of children adjudicated delinquents, are located in closer proximity to 34 St. Croix County, and offer programming that would be expected to meet the needs of children 35 and their families; and 36 37 WHEREAS, the Health and Human Services Board and the Public Protection and Judiciary 38 Committee has endorsed giving the St. Croix County Circuit Court judges' discretion on a case- 39 by-case basis to consider placement in CORE Academy and other facilities for adjudicated 40 delinquents of more than 30 days and up to 365 days in secure detention as a disposition for 41 adjudicated delinquents. 42 43 NOW, THEREFORE, BE IT RESOLVED that the St. Croix County Board of Supervisors 44 authorizes the St. Croix County Circuit Courtjudges to order placement in the CORE Academy or 45 any other facility that provide secure detention for juveniles for periods not to exceed 365 days 46 as a disposition for adjudicated delinquents with the condition that placement greater than 30 47 days would offer alcohol or other drug abuse treatment, counseling, and education services.
