Planning ( POWTS), installed on 4/26/2006 at the above location, has been in violation of State of WI,
715- 386 -4674 Comm 83.22(2)(a)3.f Plans and Specifications and is still in significant non - compliance with
Real Prope state regulations regarding a contingency plan for future POWTS replacement.
715 -3 77 A letter was sent on April 28, 2006 to Steve Derrick, the owner of record when the sanitary
Re cling permit was issued on November 18, 2005. The house had been constructed on the east
- 386 -4675 half of the soil tested area, which eliminated the future replacement area. The original
contingency plan proposed a replacement system within the soil tested area shown on a
soil report by Tom Nelson on 04/01/2004. Mr. Derrick was advised in the letter that a
licensed soil tester must provide an additional soil evaluation to designate a replacement
area. This has never been completed and is an outstanding violation for this POWTS.
Unfortunately, it has taken until now to determine that the property was sold to you and Jay
Fletch in January of 2006 and that as the builder you should have been sent the Notice of
Violation letter.
The 2006 letter requested that the responsible party make arrangements to have a licensed
soil tester submit an additional soil evaluation to the Planning and Zoning office by June 28,
2006. Subsequent NOV letters were sent to Steve Derrick, who today made us aware of
the change in ownership of the property prior to POWTS installation. You will need to
contact the current homeowner, Casey Eckardt, to make arrangements for the excavation
of test pits on the lot and subsequent submittal of a Soil and Site Evaluation report to our
office. Should either of you have any questions, please contact me at this office.

This is to provide notification that the Private On -site Wastewater Treatment

A letter was sent on April 28, 2006 to notify Steve Derrick, owner - builder, that
the county POWTS inspector determined the house was constructed on the
east half of the soil tested area, which eliminated the area for future
replacement. The original contingency plan proposed a replacement system
within the soil tested area shown on a soil report by Tom Nelson on
04/01/2004. Mr. Derrick was advised in the letter that a licensed soil tester
must provide an additional soil evaluation to designate a replacement area.
This has never been completed and is an outstanding violation for this
POWTS.
On May 21, 2009 1 inspected a repair to the POWTS forecemain, replacement
of the distribution box, and replacement of one of the effluent pipes that
discharge into the system's leaching chambers. Mike Myers, Northland
Plumbing, completed the septic system repairs and turned on the effluent
pump to make sure wastewater was getting into the new distribution box and
pipes. There were no leaks observed and the soil blockage in the pipes
appears to have been corrected so that wastewater will be treated by soil in the
dispersal cells.
As stated in my Y
Ma 5 letter to Mr. Derrick repair to blocked pipes on the
POWTS and the ongoing violation were to be abated by May 1 8 th or code
enforcement action will be initiated by our office. It is not your responsibility or

soil tested area and eliminated the future replacement area. The original
contingency plan proposed a replacement system within the soil tested area shown
on a soil report by Tom Nelson on 04/01/2004. Mr. Derrick was advised in the letter
that a licensed soil tester must provide an additional soil evaluation to designate a
replacement area. This has never been completed and is an outstanding violation
for this POWTS.

„y. On May 1, 2009 1 received a telephone request for a county on -site to document the
nee for repair malfunction n this same POWTS. I observed and documented

damage to effluent pipes that had become entirely blocked by soil. This system has
a dose chamber with a 2 -inch forcemain that discharges wastewater into a
distribution box, with three 4 -inch D3034 pipes extending out into the top ports on
leaching chambers. Each pipe had a 90- degree elbow that dropped down
approximately 10 inches or more into the chamber and did not leave the minimum 4
inches above the bottom of the cell (per page 18 of the component manual). It
appears that upon backfilling each pipe was forced deeper into the chamber, which
may have contributed to the blockage by soil. Observation pipes and vent pipes are
required to have repair couplings attached to prevent the pipes from extending

do not meet component manual instructions for min. 4 inch clearance to bottom of chambers and the pipes
extending from a distribution box are completely blocked by soil. The SDR 35/3034 pipe on all three connections
to chamber top inlet ports were approx. 10- 12 inches long after 90 degree elbow and backfill appears to have
forced the pipe onto floor of distribution cell, preventing proper flow of wastewater into treatment chambers.
System also requires additional soil boring to provide replacement area — see 2006 letter to owner.

Ven' s, if installed, connect to the upper half of the gravity flow distribution Werals�and

facing downward by the means of a vent cap or fittings. Vent caps must allow a free flow of

VII. SITE PREPARATION AND CONSTRUCTION
ve Procedures used in the construction of an in- ground soil absorption component are just as critical
as the design of the component. A good design with poor construction, results in component
;or failure. It is emphasized that the soil only be worked when the moisture content is low to avoid
compaction and smearing. Consequently, installations are to be made only when the soil is dry
ce enough to prevent compaction and smearing of the infiltrative surface. The construction plan to

A. Equipment - Proper equipment includes tractors or other equipment that will not compact the
infiltrative surface. Minimize foot traffic on infiltrative surface and avoid equipment traffic on or
over infiltrative surface.
B. Sanitary Permit -Prior to the construction of the component, a sanitary permit, obtained for
=f the installation must be posted in a clearly visible location on the site. Arrangements for
inspection(s) must also be made with the department or governmental unit issuing the sanitary
permit.
C. Construction Procedures
1. Check the moisture content and condition of the soil. If the soil at the infiltrative surface
can be rolled into a 1/4 -inch wire, the site is too wet, smearing and compaction will result,

2. Set up a construction level or similar device and determine all relative elevations in
relationship to the bench mark. It is necessary to determine the bottom elevation of the
distribution cell, land surface contour lines, and approximate component elevations critical
to the installation.
3. Lay out the absorption area within the tested designated area. Where possible lay out the
absorption areas(s) on the site so that the distribution cell runs parallel with the land
surface contours. Reference stakes offset from the corner stakes are recommended in case
corner stakes are disturbed during construction.

In- Ground System Management Plan pursuant to comm 83.54 W. A. C.
Owner's Responsibility:
The component owner is responsible for the operation and maintenance of the component. The
county, department or POWTS service contractor may make periodic inspections of the
components, checking for surface discharge, treated effluent levels, etc. The owner or owner's
agent is required to submit necessary maintenance reports to the appropriate jurisdiction and /or
the department.
Septic Tank:
Septic tank(s) are to be inspected routinely and maintained by department approved individuals
when necessary in accordance with their approvals. The use of chemical /biological "treatments" is
not required or recommended. If such additives are used, make sure they are approved by
Department of Commerce, Safety and Buildings Div.. Effluent filters are to be removed & cleaned
as necessary, with provisions to keep solids from passing the septic during removal. No more
than 1/3 of the usable tank volume may be occupied by sludge /scum. 3 year inspection: If tank
has greater than 1/3 volume sludge, tank contents must be emptied and disposed of in accordance
with NR 113 Wisconsin Administrative Code by an approved individual. If the inspector does not
recommend pumping of the septic tank, then the owner must be notified of when pumping should
be done as to not exceed 1/3 sludge volume. Septic tank should be routinely inspected to be
watertight and of good repair.
Absorbtion Cell
The absorbtion component must remain free of ponded surface water prior to pump operation. If 4
inches or more water level is detected in the observation pipes, the owner must be notified of
possible problems /failure. The designed daily flow capabilities of the component should never be
exceeded. Trees and any other deep rooted vegetation should never be planted, or allowed to
grow anywhere on the component. Activities OTHER than mowing /maintenance (i.e. excessive
walking, pets, vehicles, etc...) could compress the component and reduce it's absorbtion
capabilities and /or possibly cause it to freeze in winter conditions.
Performance Monitoring:
Performance monitoring must be done at least once every three years following the installation or
at the time of a problem, complaint, or failure.
Contingency Plan:
If the septic tank or other components therein (including floats, alarms, etc) become defective, the
defective tank or component must be replaced immediately to ensure that the system can operate
as designed. If the absorbtion component cannot accept wastewater or ponds wastewater to the
surface, the component must be repaired or replaced in it's current location by removing the
clogged bacterial mat, aggregate /leaching chamber cell, and distribution piping within the cell and
replacing failing components in order to return system to proper working order as required. If repair
is not feasible, a new system is to be constructed in a designated replacement area

SYSTEM MAINTENANCE
Improper use and maintenance of your septic system could result in its premature failure to handle wastes. Proper maintenance
consists of pumping out the septic tank every three years or sooner, if needed by a licensed pumper. What you put into the system
can affect the function of the septic tank as a treatment stage in the waste disposal system.
The property owner agrees to submit to St. Croix Zoning Department a certification form, signed by the owner and by a
master plumber, journeyman plumber, restricted plumber or a licensed pumper verifying that (1) the on -site wastewater disposal system
is in proper operating condition and/or (2) after inspection and pumping (if necessary), the septic tank is less than 1/3 full of sludge.
